Recovery of Trust Shortfall

What has the Receiver been doing to collect the Trust’s shortfall?

The Receiver and his team are exploring all options, including litigation, to recover additional funds for the Trust.

The Receiver has devoted considerable time and resources in this effort. He and his lawyers have subpoenaed over 30 people and entities and have already accumulated and reviewed tens of thousands of documents. Because litigation is likely, the Receiver cannot comment on the targets of this investigation or other details at this time.

The Receiver has not yet filed lawsuits, opting instead to ensure that he and his lawyers first put together the strongest possible case. Also, he intends to give responsible parties opportunities to replenish the Trust before filing lawsuits.

What is the role of Kravit, Hovel & Krawczyk, s.c., in this?

The law firm of Kravit, Hovel & Krawczyk, s.c., has been retained to assist the Receiver and his law firm, Mallery & Zimmerman, S.C., with discovery and litigation aimed at recovering the Trust’s shortfall. Stephen Kravit and C.J. Krawczyk, as well as other lawyers at this firm, have significant experience with securities law disputes.
